1. Promotion Overview
With every yallo Home Internet or yallo Home Internet Plus TV subscription the customer (the “Customer”) will receive a complimentary Uber One subscription valid for 3 months for free (the “Promotion”).
With purchasing a yallo Home Internet or yallo Home Internet Plus TV subscription, the Customer acknowledges and agrees to be bound to all terms and conditions regarding the yallo Home Internet subscription and that Sunrise GmbH uses data for communicating this promotion.
The Promotion is concluded by Sunrise GmbH. However, if the Customer signs up for an Uber Eats account and benefits from the Promotion, the Customer will establish a direct contractual relationship with Uber Eats Switzerland GmbH and will be bound to the General Terms and Conditions of the Promotion in as amended from time to time (current version “Bedingungen für die Nutzung des Abopasses” available via Legal | Uber) (the “Uber One T&Cs”) and the Privacy Policy (as amended from time to time, available via Privacy | Uber). Uber Eats Switzerland GmbH is responsible for the whole customer service, customer enquiries, complaints, etc. Sunrise GmbH has no further duties in relation to the Promotion and the Customer acknowledges and confirms that the use of the Promotion does not conclude any other direct contractual relationship between the Customer and Sunrise GmbH except the subscription regarding the yallo Home Internet or the yallo Home Internet Plus TV.
The Promotion starts on 19 August 2024 and ends on 30 September 2024 (the “Promotional Period”).
2. Eligibility criteria
First, Customers have to purchase a yallo Home Internet or yallo Home Internet Plus TV subscription during the Promotional Period.
Second, the Promotion is only valid for Customers who do not have an active Uber One membership. The Promotion is valid if the Customer has previously had an Uber One membership that is no longer active.
Third, at the time of registration, the Customer must be at least eighteen (18) years of age.
Fourth, the Customer must register its account in Switzerland.
Fifth, the Uber One T&Cs form an integral part of these conditions and the eligibility is always subject to the Uber One T&Cs.
3. Activation and Redemption
Upon purchasing the yallo Home Internet or the yallo Home Internet Plus TV subscription, Customers will receive an e-mail from Sunrise GmbH with a deep link (the “Promotion Link”).
The Promotion Link allows the Customer that meets the eligibility criteria to subscribe for an Uber One membership for three months for free. If the Customer meets the eligibility criteria is verified by Uber Eats Switzerland GmbH. All rights of Sunrise GmbH and Uber Eats Switzerland GmbH according to clause 6 remain reserved.
The Promotion Link is valid until 30 November 2024 and to profit from the Promotion, the Promotion Link must be used at the latest by 30 November 2024.
To profit from Promotion, the Customer must register for an Uber Eats account. By clicking on the Promotion Link, the Customer will automatically be transferred to the page of Uber Eats (webpage or app) to register for the Uber Eats account. If the Customer already has an existing Uber Eats account, by clicking to the Promotion Link, the Customer has to log into its existing account.
The Customer must follow all steps to create an Uber Eats account (e.g. input its personal details, providing a valid form of payment, accepting the Uber One T&Cs and Privacy Policy). Upon account creation or login, the free trial will automatically be activated within the Uber Eats account.
By subscribing for the Uber One membership through the Promotion Link, the Customer will enter into a monthly subscription membership with Uber Eats Switzerland GmbH as its direct contractual partner and will be bound Uber One T&Cs.
The Promotion Link can only be used once and is personalized and it is strictly prohibited to transfer this Promotion Link to another person (differing from the Customer who subscribed for the yallo Home Internet or yallo Internet Home Plus TV subscription in his/her own name).
The Promotion is not refundable, cannot be redeemed for cash, other goods or services, sold, transferred, exchanged, or credited towards other subscriptions, and will not be honored if obtained from any third party.
4. Automatic Continuation and Payment Information
By registering to the Uber Eats account and subscribing for the Uber One membership, the Customer agrees that its subscription for Uber One will automatically continue at the end of the free trial period and the then-current monthly standard price will be automatically charged to the Customer’s provided form of payment.
If the Customer does not want its subscription to be automatically continued after the Promotion period of three months has ended, he/she needs to cancel its subscription with a 48-hour notice period before the end of the free trial (end of three months).
If the subscription to Uber One automatically continues, the Customer can cancel its subscription at any time with a notice period of 48 hours before the end of the current billing period.
To cancel, the Customer needs to log into its Uber One account and follow the cancellation instructions. There will be no refunds or credits for partial months.
5. Validity and Responsibility
Code redemptions via the Promotion link that are incomplete or damaged will be deemed invalid.
No responsibility is accepted by the Uber Eats Switzerland GmbH and Sunrise GmbH for lost, delayed, or damaged data which occurs during any communication or transmission of registrations and subscriptions.
The promotion and any associated benefits or rewards cannot be transferred, exchanged, or redeemed for cash or any other goods or services, except as expressly stated in these terms and conditions.
6. Rights and Disqualifications
Uber Eats Switzerland GmbH and Sunrise GmbH each individually reserve the right, at their absolute discretion, to disqualify registrations which they consider do not comply with these term and conditions, the Uber One T&Cs and the Privacy Policy or any other applicable law.
A registration to the Uber Eats account and a subscription to the Uber One membership has to be concluded by the Customer personally and it is not allowed to make any registrations and subscriptions through agents or third parties.
Uber Eats Switzerland GmbH and Sunrise GmbH each individually reserve the right, at any time, to verify the validity of registrations and subscriptions and the Customers personal data (including identity, age and place of residence) and to disqualify any Customer who submits a registration and subscription that is not in accordance with these thse term and conditions, the Uber One T&Cs and the Privacy Policy or any other applicable law or who tampers with the entry process.
Errors and omissions may be accepted at discretion of Uber Eats Switzerland GmbH and Sunrise GmbH, each individually.
Failure by Uber Eats Switzerland GmbH and Sunrise GmbH to enforce any of their rights at any stage does not constitute a waiver of those rights.
By participating in this promotion, you agree to be bound by these terms and condition, the Uber One T&Cs, the Privacy Policy, all subject to change without notice, and applicable law.
